These Terms of Service govern your use of houstonmerrill.com and any purchase you make from Houston's Country, which is operated by Black Label Country LLC. By browsing this site or placing an order you agree to these Terms. If you do not agree to them, please do not use the site.

1. Who may use this store

You must be at least 18 years old, or have the permission of a parent or legal guardian, to place an order. By placing an order you confirm that the payment method you use belongs to you or that you are authorized to use it.

2. Products, pricing and availability

• All prices are shown in US dollars and exclude any applicable sales tax, which is calculated at checkout.
• We work hard to describe and photograph every product accurately. Colors can vary slightly between screens, and apparel sizing can vary between styles.
• Stock is limited. We may limit order quantities, discontinue a product, or correct an obvious pricing or description error at any time.
• If we cancel an order because an item is unavailable or was incorrectly priced, we will tell you and refund you in full.

3. Orders and payment

Your order is an offer to buy. We accept that offer when we send you an order confirmation, and the contract between us is formed at that point. Payment is taken at checkout through Shopify's secure encrypted checkout, and we do not store your full card details. We may refuse or cancel an order where we reasonably suspect fraud, an unauthorized payment method, or a breach of these Terms.

4. Shipping and delivery

Processing times, delivery estimates and shipping charges are set out in our Shipping Policy, which forms part of these Terms. Delivery windows are estimates rather than guarantees. Risk of loss passes to you when the carrier delivers your order.

5. Returns and refunds

Our Return and Refund Policy forms part of these Terms. In short, most items may be returned within 30 days of delivery, including for change of mind. Event tickets, digital products, personalized items and gift cards are not returnable.

6. Event tickets and live performances

• Tickets are sold for the event, date and venue shown at the time of purchase and are subject to the rules of the venue.
• All ticket sales are final. Tickets may be transferred to another person by contacting us.
• If we cancel or reschedule an event, ticket holders may choose a full refund or a transfer to the new date.
• Admission may be refused for unsafe, abusive or unlawful behavior. Events may be photographed, filmed or recorded, and attendance implies consent to appear in promotional material.

7. Gift cards, donations and fundraising

Gift cards are not redeemable for cash and do not expire except where the law requires otherwise. Donations and fundraising contributions support the recording and release of new music, are voluntary and non-refundable, and are not tax-deductible unless we state otherwise in writing.

8. Intellectual property

All music, lyrics, sound recordings, artwork, photographs, video, logos, product designs and site content are owned by Black Label Country LLC or its licensors and are protected by copyright and trademark law. You are welcome to share links to the site and our promotional images for personal, non-commercial use. You may not reproduce, sell, sample, remix, distribute or commercially exploit our music, name, likeness or artwork without our prior written permission.

9. Content you send us

If you send us photographs, video, reviews, comments or other material, you keep ownership of it and grant us a non-exclusive, royalty-free, worldwide license to use, reproduce and display it to promote Houston's Country. Please only send material you have the right to share. We may remove content that is unlawful, abusive or misleading.

10. Acceptable use

You agree not to use this site to break the law, infringe anyone's rights, transmit malware, scrape or harvest data, interfere with the security or operation of the site, or resell tickets in breach of applicable ticket resale laws.

11. Third-party links and services

This site relies on third-party services such as payment processors, streaming platforms, social networks and shipping carriers, and links to sites we do not control. We are not responsible for their content or practices, and their own terms and privacy policies will apply to your use of them.

12. Privacy

Our Privacy Policy explains what personal information we collect, how we use it and how to exercise your rights. It forms part of these Terms.

13. Disclaimers

The site and its content are provided on an as-is and as-available basis. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose, and we do not warrant that the site will be uninterrupted or error-free. Nothing in these Terms limits any statutory consumer rights you have that cannot be excluded.

14. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of any order or your use of this site will not exceed the amount you paid for the order concerned. We are not liable for indirect, incidental, special or consequential losses, including lost profits or lost data. Some jurisdictions do not allow these limitations, in which case they apply to the maximum extent the law allows.

15. Indemnity

You agree to indemnify Black Label Country LLC and its members, staff and contractors against claims, losses and reasonable costs arising from your breach of these Terms or your misuse of the site.

16. Governing law

These Terms are governed by the laws of the State of Utah, United States, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Utah, and you consent to that jurisdiction.

17. Changes to these Terms

We may update these Terms at any time. The version published on this page when you place an order is the version that applies to that order, and the date at the top shows when the Terms were last revised.

18. Severability and entire agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in force. These Terms, together with our Shipping Policy, Return and Refund Policy and Privacy Policy, form the entire agreement between you and us.
